A person say Ram, has a valid visitor visa and comes to the US on that visa. However, Ram's sister has applied for an immgrant visa under 4th preference. The petition has not yet been aproved. Does any one know of an instance where the Immigration Services cancelled the tourist visa already issued and used more than once because of the sister's petition sponsoring him for an immigrant visa?

After the petition is approved, could the tourist visa be cancelled for the same reason?
If it is so, does any one know under what section of the immigration law such a cancellation is done?

Thanks
